Case Background
Client approached us after discovering that a distant relative had illegally occupied their ancestral residential property in Abbottabad. Despite having clear title documents, the occupant refused to vacate and had even filed counter-claims alleging adverse possession.
Legal Challenge
The main challenges were: (1) proving continuous ownership despite gaps in mutation records, (2) countering the adverse possession claim which required demonstrating the client's knowledge and inaction, and (3) expediting the matter as the property was deteriorating under unauthorized use.
Legal Strategy
We filed a suit for recovery of possession under the Specific Relief Act 1877, supported by: (1) comprehensive title documentation tracing ownership back 40 years, (2) witness testimony from local elders confirming client's family ownership, (3) expert survey report establishing boundary markers, and (4) application for temporary injunction to prevent further damage. We also filed a separate criminal complaint for trespass to add pressure.
Final Outcome
The court granted permanent injunction and ordered immediate recovery of possession. The occupant was directed to pay mesne profits (compensation for unauthorized use) amounting to Rs. 8.5 lakh. Client regained possession within 45 days of judgment. Case completed in 14 months from filing.
